1. DISCLAIMER OF WARRANTIES ("AS-IS" & "AS-AVAILABLE")

THE SERVICE, INCLUDING ALL UTILITIES, FILES, CODE, INTERFACES, AND MATERIALS PROVIDED THROUGH CLOAKMYWORK (cloakmywork.com), IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CLOAKMYWORK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE UTILITY WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. BECAUSE PROCESSING OCCURS LOCALLY WITHIN YOUR BROWSER ENVIRONMENT, PERFORMANCE MAY VARY BASED ON YOUR DEVICE SPECIFICATIONS, BROWSER VERSION, AND LOCAL NETWORK CONDITIONS.

2. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CLOAKMYWORK, ITS OPERATORS, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO:

• (A) YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE;
• (B) ANY ERRORS, MISTAKES, OR INACCURACIES OF ANY CONTENT OR PROCESSED FILES;
• (C) ANY UNAUTHORIZED ACCESS TO OR USE OF YOUR LOCAL DEVICE OR BROWSER STORAGE; OR
• (D) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE.

THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY—WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE—EVEN IF CLOAKMYWORK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

3. ACCEPTANCE OF TERMS AND ELIGIBILITY

By accessing or using CloakMyWork ("the Service"), you agree to be bound by these Terms of Service and all applicable laws. If you do not agree to these terms, you are prohibited from using the Service. The Service is intended strictly as an independent utility for individual creators, artists, authors, and rightsholders seeking to protect their original intellectual property.

4. DESCRIPTION OF SERVICE AND LOCAL BROWSER ENVIRONMENT

CloakMyWork provides local, client-side browser utilities designed to apply technical deterrents to text and image files to disrupt unauthorized automated data harvesting. You explicitly acknowledge and agree that the Service operates entirely within your local browser sandbox. CloakMyWork does not upload, transport, store, host, mirror, or back up any of your content on external servers.

5. CONTENT OWNERSHIP, RIGHTS, AND USER REPRESENTATIONS

You retain absolute, unconditional ownership of any and all original content you process through the Service, as well as any derivative cloaked outputs. CloakMyWork claims zero rights, titles, or interests in your work.

By processing content, you represent and warrant that:

• You are the lawful owner of the content, or you possess explicit, documented permission from the copyright holder to process it.
• Your content does not infringe upon the intellectual property, privacy, publicity, or proprietary rights of any third party.
• Your use of the Service complies with all local, national, and international laws and regulations.

6. USER BACKUP RESPONSIBILITY AND REVERSION OF SERVICE

Because the Service does not store or maintain copies of your assets, you bear sole and absolute responsibility for preserving your original, un-cloaked files. CloakMyWork is under no obligation to assist in file recovery, troubleshooting local device memory issues, or reversing technical modifications applied during a session. We reserve the right to modify, suspend, throttle, or discontinue any part of this free utility at any time, for any reason, without prior notice or liability.

7. STRICTLY PROHIBITED USES

You agree that you will not, under any circumstances:

• Attempt to reverse-engineer, decompile, or extract the underlying source code or technical algorithms of the Service.
• Automate interactions with the Service via bots, scrapers, scripts, or heavy API-mimicking routines that threaten site stability or ad delivery.
• Use the Service to mask, obscure, or alter unlawful, defamatory, abusive, or infringing content.
• Weaponize the Service to intentionally circumvent legitimate, contractually agreed-upon rights of third parties.

8. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless CloakMyWork, its developers, operators, and affiliates from and against any and all claims, damages, liabilities, losses, costs, or expenses (including reasonable attorney's fees) arising from your violation of these Terms, your misuse of the Service, or your infringement of any third-party rights.

9. GOVERNING LAW AND SEVERABILITY

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to conflict of law principles. If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that specific provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
